HLN The Daily Share: Aaron Hernandez Closing Arguments

The fate of former NFL star Aaron Hernandez is with the jury. The prosecution spent months presenting evidence and 132 witnesses trying to show the former New England Patriots player murdered Odin Lloyd. The defense mocked it saying it was full of holes and speculation.

“If there was evidence of any reason Aaron would have had to murder Odin Loyd, don’t you think you would have heard about it in nine weeks?” Sultan asked the jury. “You didn’t hear it because it doesn’t exist.”

The prosecution started this case with a clear advantage and as you would expect they built upon it as they presented their case. But in one well-delivered closing argument the defense seemed to have made significant inroads into the circumstantial case.

For the defense to concede Hernandez was present at crime scene during the murder was double-edged sword. It gains some credibility in the face of overwhelming evidence, but based on Massachusetts “Joint Venture” law it could also create a difficult challenge.

On the other side, the defense did an excellent job of creating a laundry list of “missing” items or unanswered questions that the prosecution failed to address. Since prosecutors have burden of proof, if there’s any “not guilty” leaning jurors, they now have ammo to take into the jury room.

I like to say the game has to be played on the field and sometimes you play for a fumble and that’s just what might have happened in court today. The strong case I saw at the start of the trial is not the same case I see as the jury deliberates.
